Information has been provided to the investigation officers of ACC to highlight key issues of importance during investigation of offences prior to the coming into effect of the law no: 09/2014 (the Penal Code of the Maldives) on 16th July 2015.
Since the 1st amendment brought to the Penal Code stipulates that under clause 10 (d), where punishment is meted out after the date of coming into effect of the Penal Code for offences committed prior to the date, and where the punishment stipulated for the offence in the Penal Code is lighter than that stipulated in the respective law, or where the procedures or proceedings that the alleged offender has to be subject to under the Penal Code is lighter than that stipulated in the respective law, then the Penal Code shall be applicable to such offences, and where the punishment stipulated under the Penal Code is lighter punishment for such offences shall be meted out under the Penal Code, investigation officers of ACC was informed on and instructed on the procedures that must be followed during investigation of such cases. Further, information was also provided on the evaluation of and conclusion of cases in accordance with the requirements of the Penal Code.
The information session was conducted by the Legal Research Unit of ACC. The session was conducted on 13th September 2015 and was attended by all the Investigation Officers and members of the Commission.
