ACC has concluded the case alleging that Ministry of Fisheries and Agriculture had acted in contradiction to the law when recruiting an Assistant Resource Officer.

ACC has investigated a complaint submitted to the commission, also issue addressed in the 2010 audit report (number: FIN-2012-02) claiming that Ministry of Fisheries and Agriculture had acted in contradiction to the law and policies when allocating marks and recruiting an employee for the position “Assistant Resource Officer” which resulted with the job being granted to an undue applicant.

Upon investigation, it was found that during 2010, Ministry of Fisheries and Agriculture had published a job advertisement to recruit an employee for the position of Assistant Resource Officer in the Planning and Coordination Section. Following the announcement, the Ministry had filled and submitted the “Job applicant’s information form” (A2 form) to the Civil Service Commission under the article number 17 outlined in the Civil Service’s policy 2008. Although the investigation found that there were certain problems with the allocation of marks for the Academic section of the forenamed form, there was no evidence supporting the claim that this act was purposefully executed to provide an undue advantage to a third party. Moreover, the investigation revealed that the selected applicant is eligible for the job as per the Civil Service’s policy 2008’s article number 14 and was awarded the job based on the applicant’s education, skills and experience. Thereby, the investigation did not reveal any contravention with the law number 2/2000 (Prevention and Prohibition of Corruption Act), in the recruitment of an Assistant Resource Officer for the Ministry of Fisheries and Agriculture. Hence, the case was concluded under section 25 (a) (1) of law number 13/2008 (Anti-Corruption Commission Act), as there was no offence of corruption in the case.
